This Acceptable Use Policy forms part of and is subject to the Pulse Website Terms and Conditions (https://pulsefibre.co.uk/terms-conditions/).
References to “you” and “your” also include any other person at your home (Property) using your Pulse Website account (Account), device or login to access our Website or any of our Services.
1.1 Who we are and how to contact us
https://pulsefibre.co.uk/ is a Website operated by Open Fibre Network 2 Limited (“we”, “our”, “us”, “Pulse Fibre”).
We are registered in England and Wales under company number 17134459 and have our registered office at Synergy House Windmill Avenue, Woolpit, Bury St. Edmunds, England, IP30 9UP. Our VAT number is PENDING.
We are regulated in the UK by OFCOM and CISAS (Communications & Internet Services Adjudication Scheme). You can find more information about these organisations in our Complaints Code of Practice.
We are a private limited company.

1.2 By using our Website and accessing our Services you accept these terms
By using our Website, you confirm that you accept the terms of this policy and that you agree to comply with them.
If you do not agree to these terms, you must not use our Website or Services.

1.5 Responsibility for use
We are not responsible for any of your activities in using our Website or Services.
You must decide whether any content or communications you access using our Services is appropriate for children or others at your Property.
You must follow the rules in this Acceptable Use Policy when you use our Website or Services (as well as other terms and conditions that apply to the Website and Services).
You also need to make sure that anyone else accessing our Services at or through your Property or accessing our Services through your Account, device or login knows about and follows these rules.
1.6 Prohibited uses
You may not use our Website or Services:
- In any way that breaches any applicable local, national or international law or regulation.
- In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
- For the purpose of harming or attempting to harm minors in any way.
- To bully, insult, intimidate or humiliate any person.
- To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.

- To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
- In any way that involves child sexual exploitation or abuse.
- To upload or download terrorist content.
- To collect, stream, distribute or access any material that you know or should reasonably know, is illegal to collect, stream, distribute or access.
You also agree:
- To monitor the actions of any person who’s allowed to be at your Property and has access to the Website, your Account or the Services.
- Not to reproduce, duplicate, copy or re-sell any part of our Website in contravention of the provisions of our Website Terms and Conditions.
- Not to access without authority, interfere with, damage or disrupt:
- any part of our Website;
- any equipment or network on which our Website is stored;
- any software used in the provision of our Website; or
- any equipment or network or software owned or used by any third party.
You must not:
Give false information on our online applications, sign-up form(s) or contracts. This would include (but is not limited to) giving incorrect or fraudulent information regarding:
- direct debits, bank accounts or credit card numbers; or
- a wayleave or other permission to install our Services at your Property.
- If you do this, we can immediately end your agreement for our Services. You may also have criminal or other liability under law.
1.7 Interactive Services
We may from time to time provide Interactive Services on our Website, including, without limitation:
- Online support chat
- Social media
- Forum/Blog/Bulletin boards.

Where we do provide any Interactive Service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any Interactive Service provided on our Website, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any Interactive Service we provide on our Website, and we expressly exclude our liability for any loss or damage arising from the use of any Interactive Service by a user in contravention of our content standards, whether the service is moderated or not.
The use of any of our Interactive Services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online, as moderation is not fool proof. Minors who are using any Interactive Service should be made aware of the potential risks to them.
Where we do moderate an Interactive Service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
We do not store terrorist content.
1.8 Content Standards
These content standards apply to any and all material which you send, receive, communicate, publish, post, contribute, distribute, disseminate, collect, access, encourage the receipt of, use or re-use, upload, download, record, review or stream using our Website, Services or Interactive Services (“Contribution”).
The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.
Pulse Fibre will determine, in its discretion, whether a Contribution breaches the Content Standards.
A contribution must:
- Be accurate (where it states facts).
- Be genuinely held (where it states opinions).
- Comply with the law applicable in England and Wales and in any country from which it is posted.
A contribution must not:
- Be defamatory of any person.
- Be obscene, offensive, hateful or inflammatory.
- Bully, insult, intimidate or humiliate.
- Promote sexually explicit material.
- Include child sexual abuse material.
- Promote violence.
- Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
- Infringe any copyright, database right or trade mark of any other person.
- Be likely to deceive any person.
- Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
- Promote any illegal content or activity.
- Be in contempt of court.
- Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
- Be likely to harass, upset, embarrass, alarm or annoy any other person.
- Impersonate any person or misrepresent your identity or affiliation with any person.
- Give the impression that the Contribution emanates from Pulse Fibre, if this is not the case.
- Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
- Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
- Contain any advertising or promote any services or web links to other Websites.
1.9 Security
You are responsible for protecting your user ID, password(s) and/or login details used to access your Account and use the Services. This includes any unauthorised use of your user ID, password(s) and/or login details by third parties.
You should not:
- disclose your user ID, password(s), and/or login details to anyone else (if you do, you are responsible for that person’s use of your Account and access to our Website and Services);
- use, or attempt to use, your user ID, password(s), and/or login details to access any part of the Website or our Services that you are not authorised to access;
You must:
- take all reasonable steps to stop someone else accessing your Account and using our Services where you have not given them permission to do this.
- Protect your computer (or any other device used to access our Services) from viruses, adware, malware and spyware by installing and updating suitable anti-virus and security software
- Keep copies of your own data. We are not responsible for any loss of your files or data.
- Tell us immediately if you think any part of this Security section of the Acceptable Use Policy has been breached.
1.10 Breach of this Acceptable Use Policy
When we consider that a breach of this Acceptable Use Policy has occurred, we may take such action as we deem appropriate.
Failure to comply with this Acceptable Use Policy constitutes a material breach of the Website Terms of Use and/or the Customer Terms and Conditions upon which you are permitted to use our Website and/or Services, and may result in our taking all or any of the following actions:
- Immediate, temporary or permanent withdrawal of your right to use our Website or Services.
- Issue of a warning to you.
- Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
- Further legal action against you.
- Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
We exclude our liability for all action we may take in response to breaches of this Acceptable Use Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
1.11 How this contract can be transferred
We can transfer our rights and obligations under these terms to any third party, provided this does not adversely affect your rights under these terms.
1.12 Our liability to you and our liability limits
Our liability to you for death or personal injury caused by our negligence is without limit. We also accept liability without limit for all other areas that cannot be excluded or limited by law.
Other than as set out in the paragraph above, we will not be responsible for any liability in contract, tort (including breach of statutory duty) or any other liability which arises under or in connection with this Acceptable Use Policy and we exclude our liability to the fullest extent permitted by law.
1.13 Which country's laws apply to any disputes?
Please note that the terms of this Acceptable Use Policy, its subject matter and its formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
